1. Acceptance of Terms

By downloading, installing, or using the Quantum Fit mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Quantum Fit is a wellness and fitness application that provides personalized health recommendations, activity tracking, goal setting, and wellness content. The App integrates with Apple HealthKit and Google Fit to read and write health data for enhanced personalization.

3. User Accounts

You may create an account using your email address or through social login providers (Google, Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Health and Medical Disclaimer

IMPORTANT: The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. All health recommendations are for informational purposes only and should not replace professional medical advice.

Always consult with qualified healthcare professionals before starting any fitness program or making health-related decisions. The App provides general wellness guidance but should not be used as a substitute for professional medical consultation.

5. HealthKit and Google Fit Integration

The App integrates with Apple HealthKit and Google Fit to read and write health data. By using this feature, you authorize the App to access your health information stored in the Health app or Google Fit.

Data Usage: We do not share your health data with third parties without your explicit consent. Your health data is used solely to provide personalized fitness recommendations and track your progress within the App.

Permissions: You can revoke HealthKit or Google Fit permissions at any time in your device settings. The App will continue to function without health data integration, though with reduced personalization.

6. Subscription and Payments

The App offers auto-renewable subscription plans with the following terms:

Subscription Details:

  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Management: You can manage subscriptions in your device settings or App Store/Play Store account
  • Payment: Payment will be charged to your App Store/Play Store account at confirmation of purchase
  • Free Trial: Free trial automatically converts to paid subscription unless cancelled before the trial ends
  • Price Changes: Subscription prices may change with notice; changes will not affect current subscriptions

Subscription Plans:

  • Monthly Plan: $9.99/month
  • Annual Plan: $119.99/year
  • Free Trial: 14 days for new users

Payment Processing:

All payments are processed through Apple's App Store and Google Play Store and are subject to their respective terms and conditions. We do not store credit card information.

7. User Content

You retain ownership of any content you create within the App. By using the App, you grant us a license to use, store, and process your content to provide the service.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App and is incorporated into these Terms by reference.

9. Prohibited Uses

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the App or its systems
  • Use the App for medical diagnosis or treatment
  • Share health data without proper consent
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the App

10. Intellectual Property

The App and its content are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Medical Disclaimer: We are not liable for any health outcomes resulting from the use of our App. Users should consult healthcare professionals for medical advice.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may also terminate your account at any time by deleting the App.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App is provided, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be effective.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quantum Fit regarding the use of the App.

19. Subscription Cancellation

To cancel your subscription:

iOS Users:

  1. Open Settings on your iPhone
  2. Tap your Apple ID
  3. Tap Subscriptions
  4. Find Quantum Fit and tap it
  5. Tap Cancel Subscription

Android Users:

  1. Open Google Play Store
  2. Tap Menu > Subscriptions
  3. Find Quantum Fit
  4. Tap Cancel subscription

20. Data Portability

You have the right to export your data from the App. To request a copy of your data, contact us at privacy@quantumfit.com.

21. Third-Party Services

The App may integrate with third-party services (Apple HealthKit, Google Fit, etc.). These services have their own terms and privacy policies. We are not responsible for the practices of these third-party services.

22. Updates and Maintenance

We may update the App from time to time to improve functionality, security, or user experience. Updates may be automatic or require manual installation.

23. Beta Features

We may offer beta features or experimental functionality. These features are provided "as is" and may be unstable or incomplete.

24. Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or technical failures.
